The natural resources sector generates a high volume of disputes. However, litigation and arbitration are costly processes and companies often either lack the funds required or conclude that they would prefer to spend their money on more profitable activities. For some time now, litigation funders have presented themselves as a solution to this problem. While litigation funding has ensured access to justice for many natural resources companies in recent years, including in expropriation claims against African governments, experience shows that the devil is in the detail when it comes to litigation funding agreements.
This seminar will be a commercially oriented discussion of the following points:

- – The typical terms of a litigation funding agreement (and terms to avoid).
- – The economics of litigation funding and the factors that affect a company’s overall recovery.
